A Federal High Court has ruled that the Kano State Public and Anti-Corruption Commission lacks powers to investigate and prosecute a case of alleged collection of Dollar bribe by former governor Abdullahi Ganduje.
Justice AM Liman had while delivering judgement in the long
awaited controversial Dollar video clip case, held that the Kano Public and
Anti-Corruption Commission lacks powers to investigate the case.
The judge held that the matter is a federal case which can
only be investigated and prosecuted by a competent federal anti-graft agency
like the Economic and Financial Crimes Commission, EFCC.
He admitted that the scope of the judgment is limited to
specific powers of the State Anti Corruption Commission, and whether it can
investigate the matter, despite the fact that it has an elements of federal
case in it.
He ruled that it is only an office constituted by the
National Assembly like the EFCC can prosecute such case and as such Kano State
Anti-Corruption Commission should hands off the case.
Reacting to the judgment, counsel to the Kano State Public
and Anti-Corruption Commission, Usman Umar Fari, said the agency will appealing
the verdict.
