Every Nigerian has a right to name their dog Buhari - Falana

Femi Falana, one of Nigeria's foremost rights lawyer has spoken against the prosecution of Joachim Chinakwe, a Nigerian who named his dog “Buhari”.

According to reports,  Falana said that Chinakwe's ordeal had no place in the Nigerian statute, adding that labelling his dog with his desired name was in exercise of his fundamental rights to free speech which should not be curtailed by the Nigerian state.

''I am going to request the attorney-general of Ogun State to discontinue the frivolous charge. It is against Section 36(9) of the Constitution to charge a man for a criminal offence that is unknown to law,” Mr. Falana said.

“It is also illegal to use the machinery of government to harass any citizen. If the president is aggrieved by the naming of dog after him, he is at liberty to sue for libel. But the police cannot invoke criminal proceeding to intimidate the fellow.”

  2. Fundamental right is everybody's rightand doing what is right culturally, socially and morally is also everybody's obligation. Can a man living in Oyo town name his dog Alaaafin? Can a man living in Ado name his goat Fayose? Can a man in Ibadan name his stubborn goat Ajimobi? So there are some things that common sense must teach us to know whether it is right or not.

    1. And if they do it, does it warrant arrest according to the constitution of the country? You and your likes are unnecessarily killing yourselves with ego you certainly don't understand. You can correct and caution, but arrest? You're only making it worse and time will explain it better to you soon.

  5. Femi Falana, go to court and represent the man. Do not do it in social media. That is common sense. I just bought a cat which i shall name Femi Falana next week Sunday. you are cordially invited.

    1. In fact, you can conduct the naming ceremony somewhere close to where Femi Falana resides and let's see his reaction. I understand that man after naming his dog Buhari took it to the Hausa quarters. Is that not suggestive of trouble making and trying to disturb the peace?

  7. Buhari or any name can be used by anybody to call anything as so desired. I'll call my cat next week same name. Anybody can go to Supreme Court!

  8. For the records, this buhari is not president buhari, rather the surname of chinakwa's neighbor who because of their issues decided to slight him for naming his dog buhari. Infact, he had to inscribe the name on a paper and wore it on the dog. It was an insult to him and hence he took him to court. This has no connection to our president's buhari. Both of them should sort themselves out.

  10. Please Nigerians should be better oriented and think above board. We have heard dogs named Osama, Obama, Bingo, John Bull, Ghadafi, Jerry and the likes. These are names the owners FELT they should give their dogs....and nobody raised any eyebrow! Its entirely his or her business and I dont think that should be a matter that anyone should WASTE public funds prosecuting. There are many criminal issues in that community that the police should address and not this one. In many nations of the world, dogs are well catered for and treated with much dignity. With due respect to our president, I expect that he calls the Ogun Governor and IGP to put their houses in order. Nigeria doesnt need this drama. Why dont the police prosecute ALL who had drawn various FUNNY and derogatory cartoons in time past. I stand with YOU SIR my learned lawyer on this. Its a matter that people should simply laugh at and move on with their lives. One day, maybe...just maybe...Comedians will be prosecuted for their line of jokes!

  11. Jimmy carter was once American President and I have heard of people naming their dogs jimmy and no body was arrested. The man was only taking his dog for a walk or is that a crime too?
