James Ocholi's Death: Driver May Face Prosecution For Overspeeding


The Secretary to the Government of the Federation (SGF), Babachir David Lawal on Wednesday could not rule out the possibility of the driver that drove the late Minister of State for Labour and Employment, James Ocholi, from facing prosecution for over speeding and not owning a driver’s license.

Ocholi, his wife and son had died in a car crash on Sunday on Kaduna-Abuja road.

An interim report of the Federal Road Safety Commission (FRSC) had claimed that the driver of the car, James Elegbede, was over speeding and had no driver’s license.

Speaking with State House correspondents at the end of the Federal Executive Council (FEC) meeting, the SGF said that the final report on the accident will determine if Elegbede (the driver) will be prosecuted.

He said: “As to the issue of whether we would prosecute the driver, Yes, Nigeria is not short of laws, the problem is that Nigerians find it very difficult to obey the laws.

“There is a speed limit in place and so if anybody chooses not to obey the traffic laws, of course, it is subject to prosecution by the agencies concerned. But as to this particular incidence, I think we will leave it until the final report of the investigation comes out.

“But of course as we say accident is accident and nobody goes out deliberately to somersault and die, but as to allegations you claimed from the family, we are not aware and anybody who has anything to the contrary, that they didn’t die in an accident is free to report to the law enforcement agencies who will appropriately take it up.” he added

  1. Please spare me all that rubbish, his boss was in the car and has every right to caution if he felt the driver was over speeding, is the driver alive? Heard he died in the accident too.

    ocholi tell him...abeg shut up if u have nothing to say,if it was only the driver that died,would u have prosecuted James ocholi...yeye dey smell...

  3. Highest form of mumuism I have ever seen and heard. This sound like saying that the minister and wife could not tell if the driver was over speeding or not. How did they employ the driver if he had no license? Who has ever prosecuted ministers of works or contractors for all the death connected to bad roads or bad construction? Now they want to prosecute driver for busted tyre. Na wahoooo.

  4. Rubbish government ish. If road safety stopped them and asked for the drivers license the dead man will introduce his position and go Scott free. Now the did is done and death occurred and driver is being accused of over speeding and not owning a licence. If u ask the driver maybe his boss told him to drive as fast as possible to meet up with another meeting somewhere and the poor guy has to respect his boss. Pls driver if u read this and get prosecuted invite me to come as ur lawyer. I will make them pay for assault and abuse bcos u nearly lost ur life as well. May the soul of the demise rest in peace.

  6. It is in Nigeria that a dead man is prosecuted. Didn't the media say the driver had passes on too? why not also prosecute Nigeria government for the bad roads.... Rubbish news. The media even has the gut to insult the late minister -----that he employed a driver who is not licenced to drive. I would not even be surprised when they say the Ocholi's Paid the driver for the accident............. Does the media think all Nigerians are as stupid as they are? Me im not oooooooo.... Rubbish
