Appeal Court reverses 'Mama Taraba', Aisha Alhassan’s victory at tribunal

The Court of Appeal in Abuja on Thursday reversed the judgment of the Taraba State Governorship Election Petition Tribunal which had on November 7, 2015 sacked Governor Darius Ishaku of the Peoples Democratic Party and ordered the All Progressives Congress’ governorship candidate in the state, Aisha Alhassan, to be sworn in his stead.

In the lead judgment read by the presiding Justice of the five-man bench, Justice Abdul Aboki, the appeal court held that Alhassan and the APC had no legal right to challenge the alleged improper conduct of the primary which produced Ishaku as PDP’s candidate.

The appeal court held that the APC and Alhassan, who is currently Minister of Women Affairs, lacked the locus standi to challenge Ishaku’s qualification to contest the April 11, 2015 governorship election on the basis of alleged non-compliance of the conduct of PDP’s primary with provisions of sections 85 and 87 of the Electoral Act.

‎The appeal court therefore set aside the judgment of the Justice Danladi Abubakar and ordered that the certificate of return issued to Governor Ishaku by the Independent National Electoral Commission remained valid.

  4. A time will come in this country that any that delivers frivolous judgement will be jailed. The tribunal members should be sent back to law school to learn affresh. They deserve sack. Even a primary pupil knows their judgement was faulty and bias. Appeal court has saved the judiciary again. Thanks.

  5. Let's wait for the Supreme Court. I thought the same Fayose claims lack of confidence in the judiciary. Hiss.

  6. To my utmost surprise, none is acknowledging the fair judgment delivered by a court under the administration of Buhari, granted that the judiciary is constitutionally independent. If the ruling were the contrary, everyone would send the ruling party to the guillotine.

  7. The actions of the tribunal should be investigated and frivolous acts should be proscribed as crime to deter other frivolous partisan tribunals

  8. Must people pass comments even if no value is added. I thought the government will be commended for not influencing the judgement. This judgement has made nonsense of Fayose's prediction

Manzo that rigged you into the seat of Senitorship of northen Taraba.Today you are flexing muscle on the election that you were defeated with a wide margin. Your propaganda has given you a ministerial position that ordinarily that you are not competent to get. Why not shout up and enjoy the fruit of your propaganda?let Taraba be develop and concentrate on what is in your hand now, you gold digger!!!! if you like go to world court, you will fail thousand times, if you have conscious you should be thinking of settling Rev. Jolly who brought you from your corundum.

  10. Anonymous 3:24PM I love your post, you seems to know much about Taraba. Iam not from Taraba but I read much about the state, Gov.Jolly brought Aisha to snacthed PDP ticket then from the hand of his brother Sen. Manzo, after which he turn around to grasp AC ticket to contest against Aisha, knowing fully well that the vote of the dominance Christian from northern Taraba will goes in his favour, unfortunately his greed failed him, the same Christian votes went to the favour of Aisha as protect votes against Jolly's calculation. If there is any one to be settled, that should be Sen.Manzo. Tarabans are paying dearly from the evil manipulation of former Gov. Jolly. You are correct by telling Aisha to shout up and let her leave Taraba alone, am not happy the way innocent people are being killed courtesy of Aisha false claimed. The oldest mama in Taraba, let Taraba be please, in the name of allah.
