The All Progressives Congress and its presidential candidate, Maj.-Gen. Muhammadu Buhari, have opposed the orders of a Federal High Court in Abuja, directing that they be served through substituted means in a suit challenging Buhari’s eligibility to stand for the March 28 poll.
Justice Adeniyi Ademola had, in two separate suits challenging Buhari’s eligibility to contest in the election, last week granted ex parte orders permitting the plaintiffs to serve the defendants in the suits through newspaper publications.
The court had also granted an order of abridgment of time within which the defendants must respond to the suits.
The plaintiffs in the separate suits are Chukwunweike Okafor and Max Ozoaka. They were represented in court by their lawyers on Monday.
Apart from Buhari and the APC, the Independent National Electoral Commission is a defendant in the two suits.
On Monday, Buhari and his party, through their lawyers, told the court that they would file applications challenging the competence of the suits and the entire steps taken in the suit so far, including the orders of service through substituted means.
Though, both Buhari and the APC had yet to file any papers in the suit, their lawyers – Chief Wole Olanipekun and Lateef Fagbemi – urged the court to adjourn the matter to enable them to file all the necessary documents.
Fagbemi also urged the court to set aside the order of abridgment of time within which the defendants must file their responses, arguing that the granting of the order hinged on urgency, had already been diminished with the postponement of the poll from February 14 to March 28.
The judge then adjourned till February 23.
There are at least three other suits seeking an order directing INEC to disqualify Buhari from participating in the poll because he among other things, failed to attach evidence of his academic qualifications to the form he submitted to the electoral body.
The plaintiffs are in their separate suits contending that the INEC FORM CF 001 submitted to INEC by the APC candidate submitted to INEC was incomplete and therefore urged the court to declare the form as incompetent.
They further stated that the failure of Buhari to accompany the INEC Form with evidence of his educational qualifications and evidence of his birth certificate or affidavit of declaration of age had altogether rendered the form inchoate.
Ozoaka, in a supporting affidavit to the originating summons, stated that the INEC Form submitted by Buhari did not meet the requirements under sections 31(1)(2) & (3), and 31(8) of the Electoral Act 2010 (as amended). Why all these, are these not getting too much ? But Pres Jonathan himself just said in a church some days ago that the will of God will be done. PDP should have taken things easy knowing that after all is said and done, the will of Almighty God will prevail.

But the present act says, in addition to stating your qualifications in the form, please attach your photocopy result. That is where Buhari failed.. DeleteTell me, I graduated from the University of Ibadan (UI). And I would assume that all my University certificates are with UI. Therefore I can swear to an affidavit that I have my certificates with UI which general GMB has done in his own case. But because the military themselves are corrupt and also looking for an opportunity to scuttle democracy, they said his certificates are not with them. Therefore, the General went to collect his school leaving certificate. I think this should settle the matter. Interestingly, they now said it's fake. They should go to court and prove it. Nigerian leadership is stinking. But I believe they will fail. The General has said it, the military will take over soon. It's unfortunate.

Some commentators can not seize to surprise me. GMB has said he has submitted his certificate to INEC and they have not said otherwise. It is clear PDP want to pull. this man down but we shall march him up.

Buhari joined with a "testimonial" from his school principal and never went back to take the exams. That was 53 years ago. Now in 2014 that he has become a serious contender, the swords are out. But there is still no certificate. The lie of 53 years has been unravelled by a 1 day old truth. This is the story of Nigeria, a secondary school drop out became governor at 31, president at 41. The lack of academic capacity continues to rear its head, that's why force, coercion and similar tools are the preferred tools for buhari. Ban, kill, shoot, jail, arrest, suspend............what a pity. In a party where we had kwakansiya we ended up with this liability.

Bringing up result latter and swearing affidavit that it is with the army does make things fishy. It is an offense to swear falsely in the court of law. That also is corruption. As i have learnt the army do not keep result and Buhari as a military man should have not sworn using that. It would have being better he swore that is result is missing and that he will get a reprint from the examination body soonest or some other thing that will not implicate him. Swearing under oath is a serious offense. I am not sure yet what may happen.

That OIC will be supporting Nigeria Financial & materialy to accomplish their Mission. And every year nigeria will be paying interest to OIC. So from IBB's regime nigeria has been paying, until 1999 Obasanjo who is a Christain came & stopped it for 8yr's of his Tenure. Then 2007 Yara'dua came in & paid the outstanding depth of OBJ to OIC, with an interest & apology, he also paid his own from 2007 - 2010 & died. Goodluck Jonathan came in & Stop it for 6yr's now! And OIC constitution said that any member Nations that Stoped, this payment for 10yr's, will be Automatically Excommunicated! Now GEJ has ruled nigeria from 6th may 2010 - 2015. He is seeking for 2nd Tenure that will make it 10yr's. So that Nigeria will be delivered from the Blood sucking Islamic Religion.
