According to reports a legal practitioner, Mr. Chukwunweike Okafor, has sought the face of the Federal High Court in Abuja yesterday. This he did in order to apply for suit, saying that the APC presidential candidate Gen Buhari does not have the necessary educational qualification required to be part of the presidential candidates for the February 14 presidential election.
The legal practitioner is therefore “compelling INEC to withdraw, remove and/or delete the names of the 1st and 2nd defendants from the list of persons or political parties eligible to contest for the Office of the President of Nigeria in the 2015 general elections.”
The Section 131 of the Constitution makes known the least educational requirement for any citizen to be a part in the presidential election while Section 31 of the Electoral Act requires all presidential candidates to tender an affidavit that they have satisfied and complied with the constitutional requirements to be President of Nigeria.
Using Section 131 of the Nigerian constitution to file his suit, the originating summons marked FHC/ABJ/CS/01/2015 has Buhari as first defendant, APC second and the Independent National Electoral Commission as third defendants.
Okafor, in the suit filed through his counsel, Chief Ugo Ugunnadi, has made it known that Buhari’s West African Senior School Certificate result which he released few days ago is not a genuine one, thereby making it invalid.
The courts reopened today after being shut down for three weeks by the striking judicial workers in the country. However, no date has yet been fixed to hear Okafor’s originating summons.

ReplyDeleteBuhari himself knows he is not qualified to contest the election, after the court must have declared him ineligible, the lawyer will also file an application urging the court to strip him of all his military titles and thereby sending him to jail for perjury.
ReplyDeleteIf not for the fact that u buhari supporters are ethno-religious bigots, why would one insist on voting for a candidate who is not qualified who we all know forged his statement of result? We have to live above ethno-religious sentiments, GEJ is not good enough but Buhari is not an option. Why didn't the APC field a younger candidates in the likes of Fashola, Ribadu, Rochas, Kwankwaso why must it be buhari who is unelectable? Had it been they choose among these four candidate, APC will beat PDP hands down.
