APC caucus files fresh suit against Reps’ reconvening


The caucus of the All Progressives Congress in the House of Representatives on Monday filed a fresh suit before a Federal High Court in Abuja, seeking an order restraining the principal officers of the House from re-convening without recourse to the Speaker.

The plaintiffs are the Minority Leader in the House of Representatives, Femi Gbajabiamila, Samson Osagie, Suleiman Kawu and Garba Datti.



The defendants are the Deputy Speaker, Emeka Ihedioha; Majority Leader, Mulikat Akande; Deputy Majority Leader, Leo Ogor, Ishaka Bawa; Muktar Mohammed, Clerk of the National Assembly and the Clerk of the House of Representatives.

Other defendants are the Peoples Democratic Party, the Inspector General of Police and the Attorney-General of the Federation.
The plaintiffs filed the suit on Monday through their counsel, Mr. Mahmud Magaji (SAN).

The plaintiffs are seeking among other prayers, a declaration that the House of Representatives could not be reconvened without the express application by the leaders of the political parties being made to the Speaker.

They anchored their prayers on the provisions of section 60 of the 1999 Constitution of the Federal Republic of Nigeria (as amended) and Order V Rules 18 (2) of the standing order of the House of Representatives.

They are also seeking a declaration that the House of Representatives could not be reconvened without the Speaker of the House of Representatives expressly directing the Clerk of the House to give a notice of such re-convening to the members of the House of Representatives.
No date has been fixed for the hearing of the suit.
