Student to die by hanging for stealing GSM handsets, recharge cards


An Effurun high court, has sentenced a 24 year old secondary school student, Moses Akatugba, to death by hanging for robbing GSM handsets and recharge cards, just as a commercial motorcyclist, popularly called ‘okada’ rider was also jailed 15 years imprisonment for robbing a female passenger of her GSM handset.



Moses was convicted on a two-count charge of conspiracy and armed robbery contrary to section 6 (b) and punishable under section 1 (2) (a) of the Robbery and Firearms (Special Provisions) Act Cap R11 Volume 14 Laws of the Federation of Nigeria, 2004.

Prosecution told the court that the convict with others now at large “robbed one Mrs. Akpor Mazino of the sum of N113,930 cash, 3 GSM handsets, 54 various denomination of MTN recharge vouchers, 28 Econnet vouchers and 25 GLO vouchers valued over N100,000 at Number 30 NNPC Housing complex road, Ekpan”.

The victim in her evidence gave a vivid account of how she was robbed of the items at her shop at gunpoint.

Meantime, an Asaba high court also yesterday sentenced a 30-year-old commercial motorcyclist, Paul Nwanegbo to 15 years imprisonment with hard labour for robbing a female passenger of her GSM telephone handset.

The incident, according to prosecution took place along Direct Labour Agency, (DLA) road Asaba on the 5th of October 2011 before the ban on operation of okada in Asaba metropolis and other designated cities.

The female passenger, Amaka Okafor told the court that “on realizing the gun was a toy, I resisted him but he overpowered me after biting me with his teeth and snatched my phone from me”.

  5. Nigeria is an interesting Country. You steal N17,000,000,000.00 (Seventeen billion naira at gun point) a la Tafa Balogun, you get six months in prison. You steal a hand set of less than N200,000.00 (two hundred thousand naira) you get a death sentence!!! This is why nothing works in this place called Nigeria. God has forsaken us because of our grave injustices.

God has forsaken dis country bcox of there injustice..i believe if both of them are from rich family, the judgement will not be like this....but lets go, each and every one of us will kick the bucket and most give an account of all our deeds.

  7. To all commentators above note that armed robbery and stealing billions of public fund with the pen are two very different issues in the nigerian constitution.
    What we need now in nija is to amend our constitution so that the those that steal public fund are also well punished.
    The punishment/sentences given to all who steal public fund while in office is usually the highest sentence that can be handed out to them under our present constitution.
    And we can not have a change of constitution now because the people who are benefiting from this anomaly/injustice in the nigerian constitution are the in power who are robbing all Nigerian yet unborn.

    1. Stealing is bad. We must do everything possible to discourage it. The constitution is very lenient on pen robbers no doubt and the need to amend it is very urgent. That is not an excuse for anybody to threaten the life of fellow beings because some are stealing with pen. The masses are as guilty as these political robbers because we're the one that encourages and sustaining it.

  8. Great injustice. The rich are always set free if found in similar situation and the poor are the ones on which the law can really be effected. May God punish all these so called judges that are always giving judgement in favour of the rich!

Should this boy had been a son of to any mid class citizen or as the case may be, a rich man's son not only a rich man's son, but to one who is or has hold a peoples mandate, will the jurdge have had the mind to pass this judgement of the boy paying the price to theft by hanging. They (government) should stop telling us they are reviewing the constitution for a constitution that segrigates, do not administer equity, do not guide the consience of the decision makers, that give them the room to deal with inpunity, can never be a constitution. I don't even know why the sections were even quoted here. Had the (or a) sitting judge had the clear impertus when passing his judgement of case of coruption brought before his court that directly affect any leader in a government parastatal? May God guide their consience and never give them the room to sleep in peace with this manner of judgement.
