The Court of Appeal in Lagos, has
overturned the ruling of a high court and quashed the N25million damages
awarded to Nollywood actor, Babatunde Omidina, popularly known as Baba
Suwe.
In the ruling, the Court of Appeal re-affirmed the right of the NDLEA
to investigate, arrest, detain and prosecute drug suspects as long as
the agency acts within the law.
The court said the NDLEA had not violated Mr. Omidina's rights because it sought and got court orders from the federal high court to keep him in custody after the arrested him on the suspicion that he had ingested hard drugs.
The Court of Appeal came down heavily on the Lagos High court judge that awarded the damages against the NDLEA, describing the decision as oppressive and burdensome to an agency of government carrying out its statutory duties.
Baba Suwe's attorneys led by civil rights activist, Bamidele Aturu, has vowed to take the matter before the Supreme Court.

ReplyDeleteI don't agree with u. It is not justifiable to cast unsubstantiated aspersions on the judiciary especially when u do not have all the facts. Protection of an agency in pursuit of statutory activities is in the direct interest of the people. Otherwise we can jolly well return to lawlessness of the stone age. You must learn to devulge emotion from law. Otherwise you give impetus to criminality inadvertently. And thesame you, will turn around and accuse goverment of irresponsibility. If baba suwe feels different, the supreme. Court is next door. He can test the judgement there like a gentleman. Not sensational media grandstanding.
ReplyDeletePls let's be serious here.using ur office to bully citizens is very wrong,how can you detain a man let alone a star like baba suwe with accusations for over one month and you call that justice.25m might be too much but conpensation has to be paid for keeping that long.
