A 22-year-old man, Julius Aboy was yesterday sentenced to death for stealing N955, 600 by a Delta State High Court sitting in Warri according to The Sun Newspapers.
The trial judge, Justice Marshal Mukoro of High Court 1, who handed down the sentence told the convict that he is to die by hanging.
The convict was arraigned on a two-count charge of conspiracy to commit armed robbery and armed robbery, offences punishable under Sections 6(b) and 1(2)(a) respectively of the Robbery and Firearms (Special Provisions) Act Cap. RII Volume 14, Laws of the Federation of Nigeria, 2004.
In the first count, Julius Aboy and others now at large were reported to have on or about the 4th day of March, 2011 in Warri, conspired with others now at large to commit armed robbery.
In the second count, Julius Aboy and others now at large were also reported to have, on or about the 4th day of March, 2011 in Warri, robbed one Godwin Gwuene of N955, 600, while armed with a gun. The money was said to be Ususu contribution (savings), belonging to workers, serving as cleaners in a company in Warri.
The armed robbery gang, of which Aboy was allegedly a member, ran out of luck when an oncoming vehicle knocked down their getaway motorbike at the scene of the crime, leading to the arrest of the convict and killing of another member of the gang by an angry mob.
Justice Mukoro said the excuse of poverty, which the convict gave as reason of dropping out of school and venturing into crime was not tenable, as poverty was not a licence for criminality.

ReplyDeleteIT APPEARS PEOPLE NEED TO BE EDUCATED BY THE NIGERIAN MEDIA. THE MAN IS NOT GOING TO BE HANGED FOR STEALING AS WRONGLY STATED BY THE NEWSPAPER. STEALING IS NOT A CAPITAL OFFENCE. HE IS GOING TO DIE FOR ARMED ROBBERY 2 COUNT CHARGE. IF U SNATCH 1000 NAIRA ARMED WITH A WEAPON SUCH AS GUN OR KNIFE, THE PUNISHMENT IS DEATH. THIS IS BECAUSE, YOU ARE A MURDERER. WE ALL KNOW WHAT THESE VIOLENT PEOPE DO. MANY HAVE BEEN KILLED IN THEIR HOMES OR ON THE ROAD, OR IN BULLION VANS. THE PENALTY ON VIOLENTLY DEPRIVING OTHERS IN NIGERIA IS DEATH. PERIOD. INVESTIGATE THE JOURNALIST WHO EMBARKED ON THIS YELLOW JOURNALISM. HE IS PROBABLY AVRELATION OF THE CONVICT OR AN IGNORAMUS.
ReplyDeleteAnd if you loot public funds you are a mass murderer so why the fine?
DeleteI never knew dat penalty for robbery is now death
ReplyDeletePls Nigerians, leave armed robbery and go into pen robbery. You can make more money from pen robbery and if caught, you give 0.1% of it as plea bargain, simple! So why bother to go into armed robbery which carries death penalty? (Am only been sarcastic anyway and not encouraging crime)
ReplyDeleteThat your explanation na grammar you they speak. The death penalty can be converted to life in imprisionment if the judge desires in his full capacity as the judge.
ReplyDeleteThats why abroad such cases they will arrange for juries to look into the matter before pronouncing the penalty.
Crime is not good, let Government grant him amnesty as well
I think dis boy need to be sent to a rehabilitation centre to change his mindset abt goin to commit a crime due to d poor family background. Death penalty is too much as a penalty to his offence. This is one of d proves dat our judiciary is to punish d poor but set free d rich no matter d magnitude of dia offence. May God helps Nigeria
ReplyDeleteCorrect. ARMED Robbery is different from stealing. However as it is done in China stealing over a certain amount should attract death penalty. Unfortunately the current crop of our legislators will never pass such a law because they are more guilty of corruption than the executive. Neither can such a law emanate from the current executive because it is the worst corrupt regime Nigeria has ever had. See our dilema!
ReplyDeleteWhat is really happening in this country? People steal billions and go away with it but poor people dies with stealing peanuts. He should have been given a lesser judgement. Please tell the judge to revert the judgement before its too late because God will ask him or his children in the future.
ReplyDeleteMy dear NIGERIANS, this issue need to be addressed for God's sake. The boy didn't deserve to die for stealing less than a Million! Our leaders stole billions and some of them are enjoying state pardon, what they did is even more than carrying gun...
ReplyDeleteU dey crazy 4 trying 2 interpret dat english of arm-robbery and stealing...Person wai steal pension fund u know many people him don kill....E bi like sai ur papa follow dey steal dis country money...Idiot
ReplyDeleteyou be fool, so because the man wey steal 24billion no carry gun you know how many people don die from his action. u dey see the state of infrastructure for the country. how many people dey die every day from the looting of money made to provide those infrastructures. Armed robbery no the picking of stealing by the oga at the top,
ReplyDeleteHOW TO MAKE A MANGO TREE GROW OVERNIGHT
ReplyDeleteThere is a story of a beggar who was caught for stealing bread, and as a punishment and a deterrent to others, he was sentenced to death. As the officer lead the beggar to his execution, the beggar told him that he knew a secret of how to make a mango tree grow overnight and bear fruit immediately. It would be a pity that the secret would be lost if he got executed.
The officer decided to halt the execution and he brought the beggar to the judge, who in turn brought him to the king. So the king asked the beggar what the secret was. The beggar replied that for such a miracle to happen, the mango seed must be planted by someone who had not stolen anything before. So he turned to the officer and said: Would you want to plant the seed? The officer immediately refused saying that he had shoplifted before.
Then the beggar turned to the judge and asked if he would plant the seed. The judge declined saying that he had taken things that belonged to others and kept them for his own use. So the beggar turned to the king and said: O king, then it is left to you to plant the seed. But the king excused himself by saying that he had taken things without paying for them. And then the beggar said: So all of you had stolen some things before, and now you want to execute me just because I stole some bread because I was hungry.
Stealing with a pen is far better than stealing with a GUN..
ReplyDeleteStealing is stealing, either by gun or by pen, once someone somewhere has being deprived of their benefits or finance then they have being stolen from, so as they hang this boy, may they as well hang all this our oga at the top that has sti
ReplyDeleteso what about book haram who are killing every day in that country? are this law not in the country that they are keeping them in prison an what about the people sending them to go killing the innocent people are they not in that country are they the masses friend or does that same law not affect them or are the above those law? maybe we need to start having the law review by the masses themselves as it has come to this that the legistature can no longer review there laws and the judiciary are now doing what they so feel good to them.
ReplyDeleteUntil we fight for our constitution to be review this mess will never stop, anyway call it stealing, armed-robbery, robbery,misappropriation,looting,embezzlement,kick-back or inflation of contracts e.t.c.before our constitution was made we don't have pen-robber's in our land, but now they are every where then it is our duty to force the law maker's to make provision for them in the constitution even though they will be the first victim, in Asian pen-robbery and armed-robbery carry same death penalty, why not in Nigeria.
ReplyDeleteSteal 24billion and pay 700K to enjoy you loot, cheat in exam and get 22yrs imprisonment WHAT A MIGHTY LAW in Nigeria
ReplyDeleteif u kill this boy bcos just this little amount, what about all this our executives, ministers,my ogas at the top that loot our economy and go scott free.dats not a fare judgement.are u sure the judge does not have issues with the boy in question? where has prerogative of mercy gone to?DAT IT CAN'T BE MATED ON THIS POOR BOY.
ReplyDeletel think nigerian need to legalise arms so that we stop beaten around the bush.then every body we do his or her job perfectly.
