Economic and Financial Crimes has asked a Federal High Court, Lagos, to dismiss an application by former Enugu State Governor, Chimaroke Nnamani, seeking to travel to the United States for medical treatment.
The anti-graft agency, in a counter-affidavit, said Nnamani’s application was a ploy to delay his trial.
Nnamani and others were re-arraigned before Justice Mohammed Yinusa on 105 counts of money laundering and economic crimes involving about N4.5bn.
The accused allegedly committed the offences between 1999 and 2007 when Nnamani was a governor.
Others standing trial with him are his former aide, Sunday Anyaogu, and six firms allegedly linked to them.
The firms are Rainbownet Nig. Ltd, Hillgate Nig. Ltd, Cosmos FM, Capital City Automobile Nig Ltd, Renaissance University Teaching Hospital and Mea Mater Elizabeth High School.
EFCC’s lawyer, Kelvin Uzozie, is to adopt his counter-affidavit on Tuesday (today) after Nnamani’s counsel, Mr. Rickey Tarfa (SAN), moved the application on Monday.
Tarfa stated in the application that there was an urgent need for his client to travel on health grounds.
In an affidavit supporting the application, the deponent, Ayo Ambali, stated that Nnamani’s ailment was in 2008 diagnosed as “hypercloclesterolemnia and a high level serum Prostrate Surface Antigem”.
This, Ambali stated, caused Nnamani to travel to the US several times for medical treatment.
According to Ambali, after carrying out a series of examinations and tests the former governor was advised by his physician to return to the US for compulsory routine medical check and treatment.
But Ahamefula Mbaeri, who deposed to EFCC’s counter-affidavit said, granting the application would jeopardise the case.
