Woman jailed for removing opponent’s 4 teeth



An Upper Area Court in Gwagwalada on Thursday sentenced Eucharia Mwachukwu to six months imprisonment for causing grievous hurt to one Rakiya Umar.



The judge, Mr Waziri Adamu, however, gave her an option of N5,000 fine.


Adamu said that the prosecution had proved beyond reasonable doubt that the convict committed the offence.


Mr Luke Elemechi, the defence counsel, said his client was a first offender and prayed the court to tamper justice with mercy.


He said the convict was a widow and the only person taking care of her children, adding that any harsh punishment would not only affect her but also her dependants.


The prosecutor, Insp Martha Paul, told the court that the convict had dragged the complainant into a fight which resulted in the removal of four of the complainant's teeth.


Paul said that the offence, to which the convict had pleaded not guilty, was committed in 2010, adding that it contravened Section 241 of the Penal Code.


Delivering judgment, Adamu said that the evidence presented by the prosecution had helped the case.


"The three witnesses presented by the prosecution before the court all testified by law with concrete evidence.


"After listening carefully to the evidence of the three witnesses, the court hereby rules that the prosecution has successfully proved their case,'' he said.


Adamu said the offence committed by the convict was a voluntary one and with the intent to cause hurt.


He added that the evidence of the complainant herself showed that she was dragged into the fight by the convict.


He said any party that was not satisfied with the judgment could appeal to a higher court.
