S’Court declares Okadigbo’s wife senator


The Supreme Court on Friday declared Margery Chuba-Okadigbo, wife of the late former Senate President, Chuba Okadigbo, as the senator representing Anambra North Senatorial District.

Consequently, Chuba-Okadigbo emerged the winner in the legal battle with Senator Alphonsus Igbeke and John Emeka over the seat.

Igbeke and Emeka, and Chuba-Okadigbo, all claimed to have won the PDP primaries for the senatorial seat.
However, in its judgement on Friday, the court declared Chuba-Okadigbo as the authentic candidate of the Peoples Democratic Party in the April 16, 2011 election.

By that judgement, Justice M.U. Muktar and the panel of justices of the Supreme Court dismissed the appeal filed by Emeka, and held that Chuba-Okadigbo recorded the highest number of votes in the primaries conducted by the party.

The court, thereby upheld the judgement of the Court of Appeal, which had earlier declared her winner in the election.

The appellate court had overruled the High Court, which earlier declared Igbeke as the PDP candidate for the senatorial seat. But the SC did not order Chuba-Okadigbo’s swearing in.

The court noted that the order was not among the reliefs sought by her, and as a result, advised her counsel to file necessary applications for the order.

In another judgement, the SC upheld the judgement of the Court of Appeal, which declared Solomon Ewuga as the candidate of the Congress for Progressive Change in the senatorial election, and as a result, the Senator representing Nasarawa-North Senatorial District.

The SC dismissed the appeal by Yusuf Musa Nagogo, who claimed that he won the primary.
Ewuga is a former minister of state for the Federal Capital Territory, as well as a former deputy governor of Nasarawa State.

Also on Friday, the Supreme Court sacked Eseme Eyibo as member of the House of Representatives representing Eket/Ibeno/Esit/Onna Federal Constituency.
