The Economic and Financial Crimes Commission (EFCC) has appealed the
ruling of an Abuja High Court which discharged and acquitted the former
speaker of the House of Representatives, Dimeji Bankole, and his deputy,
Bayero Nafada, over a case of corruption and complicity in the
embezzlement of N38 billion.
The counsel to the commission, Festus Keyamo, on Wednesday, filed an appeal at the Court of Appeal, Abuja.
The EFCC is appealing on the ground that the judge, Suleiman
Belgore, erred in law when he held that Bankole and Nafada had no case
to answer with regards to criminal breach of trust because they were not
signatories to the bank accounts of the House of Representatives.
The EFCC contends that although the Speaker and his deputy were not
signatories to the accounts, they had approving authority to the said
accounts and were entrusted with them.
According to the appellant, evidence clearly shows that the accused
persons were present at meetings where it was collectively resolved to
obtain loans and increase running costs, resolutions without which the
accounts would not have been operated or accessed in the manner they
were.
In its appeal, EFCC also disagreed with Belgore that Bankole and
Nafada were not liable for theft, since they were being tried for
criminal breach of trust.
The commission is asking the Court of Appeal to grant its appeal,
set aside the ruling of the trial judge and also order a re-trial at a
lower court by a different judge.

ReplyDeleteIt is the system in naija.A small thief in the main street will steal N1k and the judiciary system will sentenced him to life imprisonment/death by hanging, with the senators calling him names-ole,ole and enacting law to discipline him and others,but failed to enact law for themselves converting public purse into their private pocket(Stealing diplomatically because they are above the law they are enacting)naijas,when are we going to tell ourselves the TRUTH.We go abroad and see how the Govt.officials live within the approved payment system without taking public money as their own or taking bribe without persecution.Here in obodo naija,it is the fashion to become a Government official in the hope to enriched themselves at the detriment of the citizens.wetin the masses of naija do Government officials whom they voted in to provide,protect for them? na wao for the likes of Bankole and co,definitely he will be off the hook of the judiciary as the norm so that he can go and enjoy the money with his families and friends as caucus member and their practices(throwing parties in aeroplane,ships and lavishing on their concubines).you Govt.officials,where is the Fear of the Lord God Almighty who made Heaven and the Earth,remember He is the Righteous Judge everlasting and one day your soul will be standing before Him to be judged with stolen naija money and bribes.Bankole and the likes-Fear God Almighty.L.A.O
